Immigration Cases

Marriage, Spouses, Fiancés
– We represented a same sex couple who have been together for many years and married. The US citizen filed to adjust the status of his same sex spouse and after about a year we were able to obtain a green card for the spouse.
– The spouse of a U.S. citizen from Peru lost his lawful permanent resident status. His wife re-petitioned for him to regain his status. However, due to numerous criminal convictions, the USCIS argued that he was inadmissible due to crimes of moral turpitude. We argued the convictions were not crimes of moral turpitude, and the court agreed. 

Detainment by Customs & Border Patrol (CBP)
– A client from the Dominican Republic was a lawful permanent resident charged with drug trafficking years ago and was a lawful permanent resident for over 15 years. Returning from a trip abroad, the client was stopped by immigration and charged as inadmissible. We successfully argued he was eligible for 212(c) relief. The immigration court agreed.
– A Cuban lawful permanent resident returning from a trip abroad was stopped at the border because of an old sex abuse charge. We argued he was eligible for 212(c) relief. The government opposed our application. We filed a motion with the immigration court. It was granted, and the 212(c) application is currently pending.

Criminal Charges & Convictions
– A Cuban lawful permanent resident residing United States for over 20 years had an old drug trafficking conviction in addition to other minor arrests. He was charged by USCIS as deportable because of a controlled dangerous substance offense and placed into removal. His case was administratively closed years ago, and as a result he was fearful of renewing his residency. We successfully reopened his case, and the relief requested was granted by the immigration court.
– We represented an individual charged with an old conviction for counterfeiting who was stopped at the airport after a brief trip abroad. The clients green card was taken and he was put into removal, The firm successfully applied for cancellation of removal as our client was a long time permanent resident and the crime was not an aggravated felony. The Immigration Judge agreed and granted our request for relief and his green card was returned. The client is now applying for naturalization.

Cancellation of Removal
– We represented a lawful permanent resident from the Dominican Republic who was returning from a trip abroad. He had a prior conviction for aggravated assault and was charged by USCIS as inadmissible as an arriving alien for a crime of moral turpitude. We argued our client was eligible for cancellation of removal. Immigration court judge agreed and granted relief.
– Our client, a long term green card holder, father of two US citizen children, whose wife was also a US citizen was granted cancellation of removal after a three year legal fight with ICE. He initially came into contact with ICE after he left the US on his honeymoon and reentered. He was stopped because he had several prior drug convections and placed into removal also known as deportation. We successfully presented his case to the Immigration Court in Newark NJ and convinced them the the drug convictions were not felonies according to the Federal Law. After a long day of testimony he was granted cancellation of removal and is now eligible for Naturalization. Congrats!!

$3,250,000.00 recovered for the death of a 64-year-old trucker struck by another trucker at Port Elizabeth, NJ. The estate’s suit for wrongful death included conscious terror, pain and suffering as well as economic losses to the family.

$420,000 recovered for client who sustained serious injuries in a MVA in New Brunswick.

We recovered $240,00 for a client who was struck as a pedestrian while crossing in a cross walk.

Slip and Fall | Premises Liability
Our client slipped and fell in a local supermarket after the display case leaked water onto the floor.  The case was difficult due to the lack of video documenting the condition of the floor at the time of the loss. Despite this our firm was able to recover $75,000.00 for her injuries as a result of the stores negligence.

Injuries Sustained | Multi-Vehicle Accident
Our client was operating a vehicle on behalf of his employer when he was involved in a multi-vehicle accident on the Pulaski Skyway in Jersey City NJ.  He sustained injuries to his neck and lower back.   The firm was able to recover $73,000.00 for his injuries.

We recovered $50,000 for a woman injured in a MVA struck by another vehicle at an intersection.

– Exiting cafeteria fell on wet floor, fractured left shoulder and had surgery.

– Fall from machine. Trapped between machines causing disc herniation at L5-S1.
– Fall from rack injured shoulder resulting in surgical repair for tears and impingement.
– Fall on wet floor while making delivery causing injury herniated disc at L4-5 and L5-S1 with annular disc bulge at L4-5 with neurological injury.
– Fall from pallet injured lower back settled for 7.5% of partial total for sprains and strains of the lumbar spine.
– Teacher fell at school causing wrist fracture with surgery in a post-operative facility.
– Fall at work resulting in multiple disc herniation, left shoulder and elbow surgery.
– Injured left leg in a fall causing surgery for tear of the anterior cruciate ligament and medial meniscus
– Tripped on stairs injured foot causing sprain and strain with a fracture of small toe.
– Trip & fall at work. Contusions and strains of the right hand.

Injuries From Lifting Heavy Objects
– Injured back lifting heavy objects. Disputed claim.
– Lifting heavy boxes injured lower back resolved for 30% of partial total disability disc bulge at L4-5 and herniation at L5-S1 with epidural injections and posterior interbody fusion, bone grafting and bilateral radiculopathy.
– Injured lower back causing disc herniation at L4-5 and disc bulge at L3-4.
– Lifting heavy object injured lower back resolved for 25% of partial total disability orthopedic and neurological injuries for herniated discs at left L4-5 with surgery and nerve root decompression.
– Injured back while working on machine. Disc bulge at L4 -5, L5- S1, herniation at T12-L1 with S1 radicalitis.
– Lifting furniture at works injured lower back. Aggravation of prior back injury.
– Lifting heavy object causing disc herniation at L5-S1. 25% of partial total disability.
– Lifting heavy box injured lower back. Disputed claim resolved.
– Lifting heavy object caused hernia, had surgical repair.
– Lifting objects injured arm. 20% of partial total for distal bicep tendon rupture with surgical repair.
– Lifting heavy object injured right arm.

Injuries From Falling Objects
– Object fell onto head causing contusion to head and fractured skull with post-concussion syndrome.
– Heavy object fell onto foot. 25% of the right foot resulting from fracture of the 4th and 5th metatarsal bone with open reduction and internal fixation.
– Struck by object in face causing fractures of nasal bone and septum with surgery.
– Struck in face by wood pallet. 25% for nasal fracture nose with open reduction and sprain and strain of the cervical spine.
– Object fell onto hand, settled for 12.5% of the left-hand resulting from the crush injury to the left from a fracture of the distal phalanx with loss of range of motion and strength of the hand.
– Bank teller hit by falling coin bag causing post-concussion syndrome and scarification.
– Coat rack fell onto right shoulder causing impingement syndrome and fracture of scapula.
– File cabinet fell on head at work causing neurological injuries.

Injuries From Workplace Equipment, Including Vehicles
– Motor vehicle accident while working causing sprain and strain of the lumbar spine with fracture of the right L2 transverse process; fracture of C6 lamina; facial lacerations; right foot injury and the right ring finger injury along with post-concussion disorder.
– Cutting wood cut hand with electric saw causing lacerations and fractures to the hand.
– Driver of fork lift involved in an accident. 60% of the right leg with open commuted fracture of the mid-fibula and distal third of right tibia with the surgical repair, rods and multiple skin and bone grafts from the left leg.
– Hydraulic lift failure resulted in multiple facial fractures, loss of smell and taste with post-concussion syndrome and partial loss of vision 50% of partial total $127,869.00.
– Pushing heavy trolley injured left shoulder. Disputed claim.
